Overview

Gerald Rohrer obtained summary judgment in a wrongful death action involving the construction of a system of deep tunnels and vast reservoirs designed to reduce flooding and improve water quality in Chicago’s waterways. After the plaintiff appealed and oral argument, the Appellate Court issued a Rule 23 order affirming summary judgment which addressed the relationship of a construction site owner to the actual construction activities and what duty, if any, the owner has to employees of an independent contractor. The Supreme Court denied the plaintiff’s Petition for Leave to Appeal.
