We also collect personal information when you apply for employment with our Firm, personally, through a recruiter or through our website. This personal information could include, among other things, educational background, school transcripts, writing samples, current and prior employment, qualification details, professional licenses, references, national ID number or work permits to work in the jurisdictions for which you applied, and photo.

We may collect this information when you (1) visit our website, www.salawus.com (the “Website”); (2) submit information by mail, telephone, or electronically; (3) sign up for newsletters, alerts, legal insights and other marketing communications; (4) register for or attend an event or program in person or online; (5) apply for employment with us; or (6) otherwise interact with us for purposes of our provision of legal services.

We may also collect personal information about you from other sources, for example, from a business associate of yours, your representative, an expert or a publicly available source, or from our own investigation.

If, on your own behalf or on behalf of your business, you retain SmithAmundsen for legal services and you provide personal information to us about someone else (such as one of your employees or business associates), we will treat that information in the same manner as described in this Privacy Notice and will consider that information to have been provided with the requisite authority needed for sharing the information. 

We also collect certain information through automatic means. For example, we use cookies, links and other tracking technologies to gather certain information regarding your use and interaction with our website. This Privacy Notice does not apply to information collected or used by any third party or affiliate, including any such party that may link to, or be accessible, via the website. SmithAmundsen is not responsible for the content or the privacy policies or practices of any third-parties, third-party websites, or third-party apps. We process personal information, as described herein, on the basis of our legitimate interest in fulfilling our service commitment to you.

We do not direct our website to children or individuals under sixteen (16) years of age. Individuals under sixteen should consult with their parent or guardian about the use of our website.

WHY WE USE OR PROCESS PERSONAL INFORMATION

Legal Services: We may use and process your personal information as necessary and relevant to the legal services we provide, promoting and marketing our legal services, assisting with managing, enhancing and improving our legal services, communicating with you about those legal services, and complying with our legal and ethical obligations related to those legal services.

Recruiting: If you are a candidate for a position with the firm, we may use personal information about you in connection with recruiting you, processing your application for the position, or, if applicable, extending an offer to you or hiring you. Where the information provided is sensitive (such as your ethnic background or your state of health) you expressly consent to our use of the information to assess your application and to allow us to carry out equal opportunities monitoring. You may also provide us with your email address to receive information on open positions with the firm. Doing so could trigger an email from us inviting you to complete an application or to send your curriculum vitae, resume or other information.

Marketing: We may process certain of your personal information for direct marketing based on your consent. You have the option of withdrawing your consent at any time. We also may process your location data, IP address, and content viewed on our websites pursuant to our Cookie Policy (linked above).

Contract performance: We may use or process personal information in connection with pre-contract activities and discussion with you, and to perform a contract that we have with you.

Legal obligations: We may use or process personal information as necessary for compliance with a legal obligation to which we are subject. This includes using or processing personal information for defense of claims against us and satisfying any government reporting obligations and requests.

Other legitimate interests:  Other interests include analyzing use of our website or services, personalizing your website experience, setting preferences in our website or electronic mailings, improving our websites, offering and managing programs and events, fulfilling our obligations to our clients and others, and managing our client and vendor relationships.

HOW AND WHERE WE DISCLOSE PERSONAL INFORMATION

We do not and will not sell your personal information. We may share your personal information with the following categories of third parties, who follow practices at least as protective as those described here, or with Service Providers with whom we have entered into contracts that require personal information be kept confidential and prohibit the retention, use, or disclosure of personal information for any purpose other than the services specified. Business and Marketing Partners: We may process additional personal information provided by you for marketing purposes, for example in correspondence relating to an event, when you let us know what legal areas you are interested in, and when you wish to be contacted by us. If food may be served at an event, we may ask about dietary requirements, which may reveal information about your health or religious beliefs. Your personal information may also be collected when you register online to receive legal updates, or when we otherwise receive your contact details. You will be provided with the option to unsubscribe or opt-out from receiving further marketing communications by following the instructions at the bottom of each communication.

 We operate our website from the United States of America and store the information we collect through our website in the United States of America. However, we market and provide legal services in countries throughout the world and given this international reach, we may disclose information collected through our website, as well as other personal information, with trusted business and marketing partners outside of the firm, for the legitimate purposes as described above

Service Providers: We may also disclose your personal information to third-party service providers that perform services for us and who are obligated to secure the information, such as attorneys, consultants, expert witnesses other outsourced service providers, continuing legal education providers, information technology suppliers, analytics providers, mailing providers, joint marketing or event providers, caterers, and security providers.

Lawful Requests and Safety: We may also disclose your personal information as required by a court order or any other legal or regulatory requirement, including in response to requests from public and government authorities outside your country of residence or to protect our rights, your rights, or the rights of others anywhere in the world.

Cross-Jurisdictional Transfers: The recipients of your personal information may be located outside of the jurisdiction where you reside. The laws of these other countries may not provide the same level of protection as the laws of your home country. By providing us with personal information about yourself, you acknowledge the disclosure of such personal information to these recipients. Any processing of your personal information outside of your jurisdiction will be in accordance with this Privacy Notice.

YOUR EUROPEAN UNION (EU) AND UNITED KINGDOM (UK) DATA PROTECTION RIGHTS

OUR EFFORTS TO PROTECT AND SECURE PERSONAL INFORMATION

We realize that you trust us to protect your personal information, and we take that trust seriously. We maintain physical, electronic and procedural safeguards that are consistent with industry standards, including by deploying a variety of security tools. We also take reasonable steps to ensure that our service providers reasonably protect your information. If the Firm becomes aware that a Service Provider is using or disclosing information improperly, we will take commercially reasonable steps to end or correct such improper use or disclosure.

While we attempt to protect the information in our possession, and account for the protection of information provided to our service providers through us, we cannot promise that information about you will remain secure in all circumstances. Please do your part to help us keep your information secure.

HOW LONG WE KEEP PERSONAL INFORMATION

We may retain your information until such time as we no longer expect to need it for a legal and legitimate purposes and otherwise in accordance with all applicable laws. At the appropriate time, we will take reasonable steps to securely delete your personal information or ensure that your personal information is de-identified, except where we are required to retain such information to satisfy legal and professional obligations.

YOUR RIGHTS WITH REGARD TO YOUR PERSONAL INFORMATION

SmithAmundsen seeks to ensure all individuals are provided with the rights mandated by their governing jurisdiction. Not all of the rights discussed herein will apply to everyone and, depending upon your jurisdiction, may not apply to you. For example, the CCPA provides California Residents the right, under certain circumstances, to request that SmithAmundsen disclose or delete their personal information.

Except as otherwise expressly discussed in this Privacy Notice, this Notice only addresses our use and disclosure of personal information we collect from you. To the extent that you disclose your personal information to third parties, including any third party website to which you navigate from our website, you are subject to the privacy practices and policies of those third parties. We encourage you to ask questions before you disclose any personal information to such third parties.

Our other obligations to you as our client, if applicable, are not addressed by this Privacy Notice. Those obligations are described in our engagement agreement or otherwise arise as a result of applicable law or rules of professional conduct.

Subject to local law, you may have certain rights regarding personal information we have collected about you. Such rights might include the right to (a) know what personal information we have collected about you, (b) know what personal information about you was disclosed to third parties, (c) update or correct such information if you believe there is an inaccuracy, (d) restrict the processing of your personal information, (e) request deletion of your personal information, (f) object to our use of your personal information, or (g) request transmission of your personal information to another data controller. We will not discriminate against you for exercising any of these privacy rights, except that the deletion of your personal information may prevent us from providing you content, invitation, or benefit that depends on the processing of your personal information.
