Amundsen Davis Contributes Amicus Brief to a Significant Win for Indiana’s Defense Bar

Our Indianapolis attorneys, Keith Mundrick and Paul Mackowski recently authored the amicus brief in the case Daniel S. Gladstone v. West Bend Mutual Insurance Company on behalf of Defense Trial Counsel of Indiana in support of West Bend. The case involved a motor vehicle accident where the plaintiff excluded evidence of his medical bills, claiming he was not seeking compensation for medical expenses, but for pain and suffering.

A significant win for the Defense Bar in Indiana, the Court of Appeals also followed the argument in the brief, stating bills are relevant evidence to pain and suffering value regardless of whether the plaintiff pursues a claim towards medical expenses.
