Not only are builders represented by their quality of construction, they are represented by their trademarks and brand name that differentiate them from other builders. Without proper registration with the U.S. Patent and Trademark Office (USPTO), a builder’s brand, slogan, mark, whatever identifies them from other builders, can lose its exclusivity. They should also be conscious of any existing marks or brands that may look similar to their own brand before they register with the USPTO.  Brad Goss and Lisa Johnson discuss builder’s rights to their trademark and brand identity in the September 2013 edition of Builder News.
