Across the country, state legislatures have passed laws expressly preempting local control--sometimes not for the purposes of providing regulatory baselines but to strip local governments of the power to act. These new uses of preemption can undermine home rule and leave municipal governments unable to address local problems including how and whether to permit recreational cannabis. Carlos Arevalo joins Nester M. Davidson of Fordham University for this timely webcast that examines the rise of these new forms of state preemption in states across the nation and discusses Illinois-specific strategies to remedy them.
