Alexis Maimonis was quoted in a recent article in WorkCompCentral, "Children Can Sue Over Birth Defects Allegedly Linked to Dads' On-the-Job Exposure."
The article explains how two teenagers who suffered birth defects because of their fathers' workplace exposure to toxins. They did not inherit their fathers' exclusive remedy and eventually pursued a civil suit against Motorola for damages.
The 1st District Court of Illinois ruled that workers' compensation was not the exclusive remedy for the two teenagers, because they were seeking damages for their own injuries, not their fathers'. The decision reversed the Circuit Court of Cook County, which had granted Motorola's motion to dismiss.
Alexis gave insight saying "I do think the court got it right. How else is the kid going to get a remedy?" and then went on to say "...I think the court reasoned properly and I’m proud because it was an Illinois court that did it."
