Gary Zhao, a partner in the firm's Chicago office, recently won a forum non conveniens motion in the Northern District of Illinois. His client, an internet business based in North Carolina, was sued by the plaintiff for false online advertising in the Northern District of Illinois. The plaintiff sought damages totaling $38 million dollars, including statutory damages, competitive injury damages, punitive damages, and attorneys fees. Gary brought a forum non conveniens motion seeking to transfer the matter to the Western District of North Carolina. In the motion, Gary successfully argued Illinois is not a proper forum for this litigation and since the client has little or no ties to the state. The court ruled in favor of the client and rejected the plaintiff’s choice of forum. The court further pointed out that the revenue from the clients’ online sales in Illinois was no more than 1 to 2% of its overall revenue.
