This past June, the United States Supreme Court ruled that underwater second liens cannot be stripped off or removed in a chapter 7 bankruptcy case. This ruling reversed a lower court decision by a Federal Court of appeals that such liens could be stripped off. Hear John Collen discuss how he and SmithAmundsen filed a friend of the court brief that included arguments adopted by the Supreme Court in its unanimous favorable ruling for banks. During the presentation John will discuss how winning arguments were formulated and will give attendees a glimpse into the world of Supreme Court Advocacy.
