Russ Ware, a partner in the firm's Milwaukee, WI office and member of the firm’s Professional Liability Practice Group, authored an article in the August 2010 issue of the Professional Liability Underwriting Society Journal. His article, “The ‘In Pari Delicto’ Defense in Legal Malpractice Actions—Its Nature, Use and Limitations,” discusses how the in pari delicto defense can be raised in legal malpractice cases where the plaintiff alleges the lawyer intentionally or negligently counseled the client to commit wrongful acts, and where the plaintiff seeks compensation for losses suffered by the plaintiff as a consequence of committing the wrongful acts.
