Tim Epstein Quoted in Sports Litigation Alert Article

Tim Epstein, Chair of the firm’s Sports Law Practice Group, was quoted in a February 24, 2012 article published in Sports Litigation Alert titled “Number of Plaintiffs Swell as Law Firms Seek out Former NFL Players, for Concussion Litigation.” The article discusses how law firms are soliciting former NFL players to participate as potential plaintiffs in litigation against the league, claiming it concealed critical evidence on the health effects of concussions and not taking the appropriate measures to protect the players’ health.

In the article, Tim acknowledges how unique this amount of litigation is in the area of sports. “We have never seen anything like this in the sports context. A comparison that comes to mind is the Mesothelioma Asbestos related suits, where firms have literally placed billboards, television, and radio advertisements all over the country seeking potential plaintiffs.” He also distinguishes these lawsuits from the latent illness cases by explaining how easy potential plaintiffs are to find and their incentives to participate in the litigation.
