Retail Litigation
Attorneys in SmithAmundsen’s Retail Practice Group provide clients with both superlative defense trial skills and assistance in reducing their overall risks. Our goal is to partner with our clients to handle their business matters more efficiently. We focus on the bottom line and, as a matter of practice, continually look for creative means of decreasing our clients’ total expenditure on claims.
Our role begins before suit in the claims process as we acknowledge the value of providing early warnings on potential claims and educating our clients about risk management and on the latest trends in the law that affect their business.
Our retail attorneys are available to assist in the investigation of major retail-related claims. We formulate on-site defense strategies, protect privileged communications, and counsel employees. Members of our Immediate Response Team are available 24 hours a day, seven days a week. As a matter of practice, we provide our clients with initial evaluations, with a detailed defense plan, within 60 to 90 days; settlement options such as our Pre-Trial Conference Program and/or plans for Alternative Dispute Resolution; and claim prevention (including store employee and adjuster training).
SmithAmundsen’s retail attorneys have developed a comprehensive understanding of the businesses in which our clients operate and are specifically trained to defend the types of claims faced by retailers including:
Premises Liability (such as falling merchandise and slip and fall claims)
Product Liability
Malicious Prosecution/False Arrest
Third-Party Criminal Acts
Pharmacy Liability
Asbestos Litigation
