SmithAmundsen’s School Law attorneys have significant experience representing educational institutions in all aspects of school law, including special education, student rights, personnel and labor matters, governing board policies and procedures, and general tort liability.
Our attorneys encompass the knowledge to advise, represent, and defend school districts in the following matters:
Staffing decisions and personnel matters
Collective bargaining
Allegations of sexual abuse and/or sexual harassment of students
Grievances through arbitration involving certificated and classified employees
Claims by the state civil rights division and/or Equal Employment Opportunity Commission on charges of discrimination, involving charges of sexual harassment, sex, race, age, and national origin
Issues regarding the Fair Labor Standards Act ("FLSA"), Family and Medical Leave Act ("FMLA"), Americans with Disabilities Act ("ADA"), and § 504 of the Rehabilitation Act
Governing board policies
Special education matters under the Individuals with Disabilities Education Act and Section 504
Student rights
Our practice also includes providing counsel for advocates and lawyers of parents and children with disabilities. In addition, our attorneys are versed in general tort liability and represent school districts as well as private day care providers directly and through their insurance liability carriers relating to claims of negligence and property damage.
