Too often, employers look to their collective bargaining agreements and are confused with regard to employee drug testing. Sometimes the collective bargaining agreement is so vague; employers usually have more questions than answers relating to their rights to subject union workers to drug testing. Other times the collective bargaining agreement fails to address critical scenarios whereby employers reserve the right to subject the employee to a drug test— creating an unsafe workplace and leaving the employer frustrated and paralyzed. It's time for employers in union settings to identify the weaknesses of their drug testing policy, and work with labor to strengthen their drug testing program for the benefit of management, labor and the public.
