Among the cases reported in this issue, the Illinois Supreme Court held in Lebron v. Gottlieb Memorial Hospital, 2010 Ill. LEXIS 26 (Docket Nos. 105741 & 105745, filed Feb. 4, 2010), that the medical malpractice caps on noneconomic damages constituted a legislative remittitur that violated the separation of powers clause in the Illinois constitution.
